POPULAR PARTY LEADERS PREPARING A NEW COMPLAINT AGAINST HIM (THE FOURTH) FOR ANOTHER ALLEGED CRIME OF PREVARICATION

The most controversial Spanish judge Baltasar Garzon knew at least since 7 April 1997 that under the umbrella of leader of separatist Trade Union LAB (Langile Abertzaleen Batzordeak), Rafael Diez Usabiaga hid another personality quite different: he was one of the principal leaders of ETA in Spain territory.

So was reported to the judge by the Information Service of the Civil Guard in a memorandum in which it said that the former secretary general of this trade union remitted and received weekly information of the Executive Committee of ETA through Juan José Latasa Guetaria Miguel Ángel Eguibar Mittxelena, the clandestine messengers of the terrorist group.

The police force also provides plenty document seized to several terrorists and others captured during a raid in his house and in the office of the Trade Union. Also several files more achieved in France after the arrest to the José María Dorronsoro Malatxetxebarría in which Díez Usabiaga using the nickname of Hontza (Owl) in all his communications with the terrorist group.

What is really significant is that the leadership of the terrorist group rather than shoot him offered all sorts of “reasons”».

Weighing all this evidence that seems linked to the terrorist group, the former secretary general of LAB was not in jail until October 2009, when he was arrested by order of the magistrate of the Audiencia National . Baltasar Garzon accused along with others, including Arnaldo Otegui, trying to rebuild illegal Batasuna under the new name of Bateragune, political party with which ETA intends to return to the institutions in upcoming elections.

Unexpectedly and against all odds, on April 26, the judge decided to release him to the prison. The excuse used to justify this arbitrary and unjust decision as being contrary to law was that the ETA leader had been claimed by his mother, Dolores Usabiaga Olarra, 75 years old, which appointed him as her 'special attendant' in spite of enjoying an “iron health”.

The strange change of attitude from the judge has surprised everybody. Especially since the mother of the former leader of LAB had not requested, as the judge said such kind of care in social services in the town’s and because during the last year she received the daily attendance of Ana and María Consuelo, the sisters of the alleged chief of ETA.

Borja Semper Basque Popular Party (PP) leader says: «Since it was released has not appeared at home to see his mother. Moreover, Lasarte City Council certifies that there is no resolution regarding to the depend-ence of the mother with respect to former Trade Unión chief»

According to the opinion of the member of the PP the affaire is a possible prevarication or, at best, a poorly reasoned decision by the judge, based on fraudulent facts. «We believe that Garzon has been engaging in preferential treatment to a member of ETA-Batasuna with respect to any other citizen, a real shame, concluded Semper, whose political party intends to lodge a complaint against the judge for a new crime of prevarication

Moreover, the release of the terrorist is interpreted in political circles as the last service of the controversial judge to the Government and the Spanish Socialist Party (PSOE), before a member of the Supreme Court issued an order to hold public trial in one of the three judicial summary in which Garzon is processed.

Although this legal text was intended to defend Spain from an external enemy there are people who think it could be applied to traitors.
